Seller will follow all provisions of Public Law 94-469 Toxic SubstanceControl Act, Part 761, polychlorinated biphenyls (PCB's), Subpart C, Paragraph 761.20 (A)(1), and Annex V Section 761.44 (A) with regard tomarking PCB transformers, PCB large high voltage capacitors, equipmentcontaining a PCB transformer or PCB large high voltage capacitor, PCB containers, electric motors using PCB coolants, hydraulic machinery using PCB hydraulic fluid, heat transfer systems using PCB's and PCB article containers which contain articles or equipment that must be marked. All marking shall be completed before any of these items are delivered to MDC. All bids for items containing PCB's shall be so noted on the purchase quotation.

All radioactive materials are to be delivered to Bldg. 102 - Radioactive Vault Room, via Bldg 101 Receiving Dept., except as specifically authorized by the Radiation Safety Officer (314) 234-4005, per C.P. 6.225.

Prior to shipment of chemical substances, including mixtures (solids, liquids, cryogenic liquids, gases) hereunder, the Seller shall provide MDC (see para. 4) with a copy of the Material Safety Data Sheet (MSDS). For example, contracts for adhesives, paints, solvents, cleaners, etc. will need a MSDS. Such MSDS shall include all required information as described in 29 CFR Part 1910.1200(g). In addition, the information outlined in paragraph 3 shall be either included on the MSDS or an attachment thereto. 2. DEFINITIONS -- A chemical substance is a chemical or mixture which: a. Is defined as a hazardeous chemical by OSHA, DOT, EPA and/or ICAO. b. In the course of normal operations or foreseeable emergencies, may produce dusts, gases, vapors, mists, fumes or smoke. 3. CONTENTS OF MSDS - In addition to the information required by law, MDC requires the following information on the MSDS (or an attachment thereto: a. Clearly identify the Chemical Abstract Service (CAS) number (if Available) of the chemical substance and/or each component constituent of a mixture except for proprietary or trade secret ingredients. b. Indicate whether or not the chemical substance or constituent thereof is: (1) listed on the TSCA Chemical Inventory. (2) on the TSCA 12(b) Export Notification list (3) subject to a Significant New Use Rule (40 CFR Sub. B Part 721). c. Indicate the National Stock Number (if known). d. Volatile Organic Compound (V.O.C.) - content for the mixture is to be indicated in terms of VOC: pounds/gallon or VOC: grams/liter 4. The Seller shall submit one (1) copy of the MSDS, unless a previous copy of the MSDS has been submitted to the address below and is still valid. The goods on this purchase order must be shipped in UN specification packaging. A test report and package drawings demonstrating compliance with the UN specifications must be provided. Requirements for UN specifications can be found in the International Civil Aviation Organization (ICAO) regulations. Seller must send the test reports and drawings to: McDonnell Douglas Corp. 1. Seller will insure that the tank, piping, couplings, gaskets and any other equipment used in the delivery, transfer or removal of the material will be compatible with the material and will safely handle the pressures required for solution transfer. The tank truck to be used shall have been constructed in accordance with CFR Title 49. 2. If any Seller supplied hose is to be used in delivery operations, such hoses must be pressure tested by MDC Plant Engineering Maintenance prior to use on MDC premises. MDC Plant Engineering Maintenance will attach a "Transfer Hose Functional Test" tag to hoses that pass inspection. The tag must be removed after the solution transfer is completed. (NOTE- Suction hoses will not require testing.) 3. (a) When compressed air is used to pressurize Seller's tank truck for solution delivery, the pressure shall not exceed the pressure rating of the tank. In no case shall the pressure exceed twenty (20) PSIG. (b) Tanks shall be equipped with a pressure relief valve, a manually operated vent valve and a pressure guage, all of which must be in good working order. 4. Unless the driver is wearing safety equipment that offers equivalent safety protection as specified in 3033A, B or C, as contained herein, the driver shall instruct MDC maintenance supervision and maintenance personnel engaged in transfer operation on hook up and how to operate valving, pumps, etc., to make the required transfer. Driver shall then be required to leave the cordoned off transfer area before transfer commences and shall no re-enter cordoned area until the transfer is completed and lines have been flushed and disconnected. 5. The driver shall be properly instructed by Seller as to the building, tank location and personnel to be contacted for delivery or removal. Such information is specified elsewhere in this purchase order.

The truck driver and any assistant or accompanying personnel of Seller shall wear the safety equipment specified below, or such equipment as offers equivalent safety protection: 1. Chemical Resistant suits compatible to the chemical being transfer or handled. 2. Full facepiece positive pressure pressured demand respirators with minimum 5 minute escape bottle. Respirator users must be clean shaven to perform this task to ensure adequate respiratoy protection. 3. Hand protection shall consist of Neoprene or similarily compatible material for handling chemicals being transferred or handled. In addition, a latex or similar liner glove must be worn inside the exterior Neoprene or similar glove. Exterior gloves shall be worn with the coverall sleeve on the outside of the glove and shall be sealed with tape. When taping sleeves to the gloves, leave a 2 inch tab on the tape for easy removal. 4. Knee length chemical resistant boots shall be worn with the legs outside the boots and taped to prevent liquid entry.

Chemical resistant suits compatible to the chemical being transferred or handled. 2. Full facepiece respirator with P-100 (HEPA) Filters. Respirator users must be clean shaven to perform this task to ensure adequate respiratory protection. 3. Hand protection shall consist of Neoprene or similarly compatible material for handling chemicals being transferred or handled. In addition, a latex or similar liner glove must be worn inside the exterior Neoprene or similar glove. Exterior gloves shall be worn with the coverall sleeve on the outside of the glove and shall be sealed with tape. When taping sleeves to the gloves, leave a 2 inch tab on the tape for easy removal. 4. Exposures less than 25% of the applicable exposure limit (Permissible Exposure Limit, ACGIH Threshold Limit Value, etc.): Wear safety glasses, faceshield, and Neoprene gloves. 2. Exposures greater than 25% of the applicable exposure limit (Permissible Exposure Limit, ACGIH Threshold Limit Value, etc.): Wear safety equipment in the manner described in paragraph 1 and contact Boeing IDS - St. Louis Occupational Safety and Industrial Hygiene for respiratory protection requirements at (314) 232-3271.

Positive: The Seller certifies these goods are in compliance with the ozone depleting substances labeling requirements under US law. One of the above statements must appear on shipping documents (bill of lading, manifest, commercial or pro-forma invoice, etc.) for U.S. Customs Department officials at the time of importation. The precautionary labeling, necessary when issuing a postive statement, must accompany the positive statement and must be in compliance with 40 CFR Part 82 Subpart E.
